Driver Involved in Paul Smart’s Fatal Accident Receives Suspended Sentence

The motorist implicated in the tragic accident that took the life of motorcycle icon, Paul Smart, has evaded jail time, having been given an eight-month suspended sentence last week.

David Gladwell, the driver in question, confessed to the charge of causing Mr. Smart’s death due to negligent driving. Gladwell’s defense attorney, John Dye, described his client’s actions as a “colossal and disastrous error” in court, and revealed that Gladwell has abstained from driving since the incident, and never intends to drive again.

The case revealed that Gladwell, a 66-year-old part-time concierge, had come across a traffic jam in October 2021. Hoping to bypass the congestion, he attempted a U-turn on the A21 to return in the opposite direction. This action led to the fatal accident that cost the life of one of Britain’s most esteemed racers. Paul Smart, who was riding in the opposite direction, was unable to evade a collision with Gladwell’s Ford Focus.

KentOnline reported that a statement from Mr. Smart’s son, Scott Smart, was presented to the judge, in which he requested that Gladwell not be incarcerated. In his statement, Scott described his late father as “the architect of our entire family,” adding that his father’s life and career had served as the impetus for his own successful career in motorcycle road racing.

This report updates a previous article published in February 2023. The initial article detailed David Gladwell’s admission of guilt for causing Paul Smart’s death in a vehicular collision in October 2021.

At the time, Gladwell, a resident of Acland Close, Plumstead, made his plea of guilt at the Sevenoaks Magistrates’ Court on February 9, 2023.

The fatal incident occurred on October 27, 2021, on the Lamberhurst Bypass, when Gladwell’s U-turn on the A21 resulted in a collision with Mr. Smart, who was on a motorcycle.

James Nichols, the prosecutor, stated: “This is a case of a fatal road traffic crash on the Lamberhurst Bypass. Mr. Gladwell encountered slow-moving traffic, attempted a U-turn in the opposing lane, and collided with Mr. Smart’s motorbike. Regrettably, he succumbed to his injuries.”

The case has now been transferred to Maidstone Crown Court for Gladwell’s sentencing. Meanwhile, he has been given a provisional driving ban. The date for his sentencing remains to be determined.

Paul Smart was a legendary figure in international and British motorcycling circles, renowned for his tenure with Ducati and multiple podium finishes at World Championship level. He achieved victories at key events such as the Manx Grand Prix and the Transatlantic Trophy match races. In 2006, Ducati honored Smart’s 1972 Imola 200 victory on a Ducati 750 Imola Desmo with the Ducati Paul Smart 1000 LE.
